Terms of Use for the buyer

1. DEFINITIONS
1.1. For the purposes of this term of use, it is considered:
1.1.1. BUYER is any natural or legal person who registers with the aim of making purchases through the Maná website.
1.1.2. SELLER any legal entity that makes products available for sale through the Maná website.
1.1.3. SITE is the set of pages and services available on the domain www.manamarketplace.com.br


2. ADHERENCE AND MODIFICATION OF THE TERMS OF USE
2.1. The BUYER, when registering and/or making a purchase on the SITE, will be agreeing to all the provisions contained in this term of use, and must read it and ensure that he or she fully understands it.
2.1.1. Maná reserves the right to modify these terms of use, without prior notice, which is why the BUYER must first consult the current provisions whenever using the SITE's services.


3. SERVICES AVAILABLE
3.1. Maná offers the following services to BUYERS on the SITE:
3.1.1. Search tool for registered products;
3.1.2. Tool for purchasing registered products, with online payment method available;
3.1.3. Registration and monitoring of purchases made;
3.1.4. Service to BUYERS via company WhatsApp.


4. PRIVACY AND DATA SECURITY POLICY
4.1. Maná is committed to the security and privacy of BUYERS’ data, so that:
4.1.1. Does not record BUYERS' debit or credit card data and, under no circumstances, provides it to third parties;
4.1.2. Does not provide third parties with any other registration data of BUYERS, except when legally permitted and strictly necessary for the operationalization of the purchasing process or as determined by the competent judicial authority;
4.1.3. Does not distribute spam and all institutional messages sent to BUYERS via email can always be disabled through a link in the message itself or at any time through the Customer Service Channel;
4.1.4. It will never ask BUYERS for their password, user name, credit card information or other personal information via email or with executable attachments (extension exe, com, scr, bat) and download links, in a way that expressly warns in the meaning that any request received under these terms will be ignored;
4.1.5. It adopts the legally required levels of data protection security, having installed all technical means and measures within its reach to prevent the loss, misuse, alteration, unauthorized access or undue removal of the personal data collected.


5. WARRANTY
5.1. Purchases made through the SITE are partly operated by the SELLERS, who are responsible for:
5.1.1. The correct registration of products, including an adequate description of their characteristics.
5.1.2. The availability of the product in stock;
5.1.3. The shipment of the product to the BUYER, within the deadline and conditions informed when the purchase and sale was concluded;
5.1.4. Adequate packaging of the product to avoid damage during transportation.
5.2. In the event of any complaint by the BUYER regarding the purchase made, it will be forwarded to the SELLER for an appropriate solution to the problem, aiming for the BUYER's complete satisfaction. The entire process will be led by Maná's service team until the total solution is reached.
5.2.1 If the complaint is valid and the SELLER does not adequately resolve the problem, Maná will reimburse the BUYER for the amount paid, plus shipping costs, as well as return shipping, if applicable.
5.3. The reimbursement guarantee established here will be implemented by Maná:
5.3.1. When the product has already been sent, after proof of its return by the BUYER to the SELLER;
5.3.2. Using the same payment method used when purchasing.


6. DELIVERY TIME
6.1. The delivery time for products varies according to the location, the payment method chosen, the type of shipping and the availability of the product purchased.
6.2. Just below the product there will be a field to fill in the zip code for the delivery address. When entering the zip code, the tool will provide the product's delivery time, shipping types and prices for that region.
6.3. If you purchase products from different SELLERS, the product from each SELLER will incur shipping costs and will be delivered separately. In the same way, if more than one product is purchased from the same SELLER, the products can be delivered separately.


7. EXCHANGES AND RETURNS POLICY
7.1. As prescribed by the Consumer Protection Code (art. 49), Maná guarantees the BUYER the right to withdraw from the purchase within 7 (seven) days from receipt of the product, with a refund of the amount paid, including shipping costs. shipping and return, if applicable.
7.2. For returns beyond 7 (seven) days from receipt of the product, the SELLER will be responsible for making the exchange decision. In these cases, the BUYER may consult, through the SITE's Customer Service Channel, regarding the feasibility of the exchange.
7.3. If any manufacturing defect or defect is found in a purchased product, the BUYER may file a complaint with Maná, within a period of up to 30 (thirty) days from receipt of the product, as prescribed in the Consumer Protection Code (art. 26, I) .
7.4. Product returns must be made by the BUYER in accordance with the instructions to be received.
7.5. All requests for exchanges and returns must be made exclusively through the company's WhatsApp.


8. THE PURCHASE PROCESS
8.1. The purchased product will be sent after payment confirmation.
8.2. Orders made using the bank slip will only be released for delivery after payment confirmation (on average 2 to 4 business days). Invoices not paid after the period of X days will be canceled and the customer will have to make a new purchase.
8.3. We reserve the right to change, without prior notice, the payment methods offered on the SITE, aiming to promote better efficiency, convenience and agility in the sales process.
8.4. Maná is not responsible for any difficulties in making payment.
8.5. In case of suspension of the Site due to Internet access problems, intervention by hackers, viruses and other malicious software, software and hardware failure, power outage or as a result of fortuitous events or force majeure or for any problem of which Maná has no control, no compensation will be owed to users, and it is certain that, as soon as the situation is normalized, browsing on the Site will continue.
8.6. In the case of purchasing an NFT, the buyer must enter the wallet code in the specific field available on the checkout page.


9. BUYER’S RESPONSIBILITIES
9.1 The BUYER is responsible, in addition to others set out in this terms of use:
9.1.1. Only provide true registration data and keep them updated;
9.1.2. Ensure the confidentiality of your password to access the SITE, not providing it to third parties;
9.1.3. Immediately notify Maná, via WhatsApp, about the misuse of your email or password to access the SITE;
9.1.4. Maintain cordiality in language when using the Customer Service Channel.


10. OPT-OUT
10.1 In the event of non-compliance with any item of these terms of use by the BUYER, Maná may unsubscribe from the SITE, whether temporary or definitive, regardless of prior notice.


11. APPLICABLE LAW AND JURISDICTION
11.1 This term of use is governed by Brazilian law.
11.2 Maná and the BUYER elect, with the express waiver of any other, however privileged it may be, the Central Forum of the District of São Lourenço, state of Minas Gerais, to resolve any disputes arising from this instrument.
